Zhao Wanyi Lectures for Jurists' Lecture Room

Following the success of the first lecture, our school held the second lecture of “SDUFE-Jointide Jurists’ Lecture Room” on Oct 27, 2019.

The speaker we invited was Prof. Zhao Wanyi. He is China’s famous jurist of civil and commercial law, academic leader of civil and commercial law at Southwest University of Political Science & Law, editor in chief of Modern Law Science, doctoral tutor, vice president of the Commercial Law Research Institute of China Law Society, and vice president of the Legal Journal Research Institute of China Law Society.

The event falls into two parts. The first part was attended by leaders, civil and commercial law teachers and postgraduates from our school.

In this part, in the school’s lecture hall, Room 4616, Prof. Zhao gave a lecture on the topic of “How to write legal academic works”. He elaborated on the do’s and don’ts for the application of the National Social Science Fund as well as the writing of legal academic papers.

Prof. Zhao pointed out that the topic selected for the National Social Science Project should be novel, scientific, forward-looking, suitable, and accurate; that the applicant should be familiar with the topic and have conducted relevant research in the field; that to demonstrate the topic we must explore the origin of the content and be logical.

He believed, for paper writing, that we must write with a definite purpose, have the awareness of questions, design the writing framework and logic, then refine our language, make our expression varied and avoid repetition, and should write the abstract.

In the second part, Prof. Zhao gave an academic lecture entitled “Relations between Civil Law and Commercial Law in the Age of Civil Code” to teachers and students from our school in its moot court.

He argued that civil law and commercial law have different ethical basis and value orientation. The former centers on the ethics of natural persons and works under the principle of fairness, while the latter centers on legal persons and focuses on rationality and efficiency. Thus, it is impossible to fully implement the basic principles and system design of civil law in commerce. To some extent, civil law shouldn’t be involved too much with the rules for market economy. Instead, it should be kept distance from market economy.

During the finial Q&A session, students actively voiced their opinions and raised questions, and Prof. Zhao answered them patiently.
